Terms of Service
These Terms of Service (“Terms”) constitute a legally binding agreement between Latitude Social (“Company,” “we,” “us,” or “our”) and the individual or entity (“Client,” “you,” or “your”) accessing our website and utilizing our social media management services (the “Services”). By subscribing to any of our plans or using our website, you agree to be bound by these Terms.
1. Description of Services
Latitude Social provides recurring social media content creation, scheduling, and posting services. We act as a specialized subscription service designed to maintain a consistent online presence for your brand. We are not a full-service marketing agency; our scope is limited to the deliverables outlined in your specific subscription plan.
2. Subscription and Billing
-
Subscription Model: All Services are provided on a month-to-month basis with no long-term contracts.
-
Automatic Renewal: Your subscription will automatically renew each month on the anniversary of your sign-up date. The credit card or payment method on file will be charged the then-current rate for your plan.
-
Pricing: All prices are listed in USD. We reserve the right to adjust pricing with at least 30 days’ notice to existing Clients.
3. 14-Day Money-Back Guarantee
We offer a “100% Delight Guarantee” for new Clients. If you are not satisfied with the quality of the content produced within the first fourteen (14) days of your initial subscription, you may request a full refund. This guarantee applies only to the first month of service and is void if you have already approved and published content to your channels during this period.
4. Cancellation and Refund Policy
-
Cancellation: You may cancel your subscription at any time through your account dashboard or by contacting support. To avoid being charged for the next billing cycle, cancellation requests must be submitted at least seven (7) days before your next renewal date.
-
No Refunds: Beyond the initial 14-day guarantee, all payments are non-refundable. Since we begin work on your account immediately upon payment (research, strategy, and content drafting), we do not offer pro-rated refunds for partial months of service.
5. Client Responsibilities
-
Access: You must provide the necessary credentials or “Editor” access to your social media platforms via our secure onboarding tool. We are not responsible for delays caused by your failure to provide access.
-
Feedback and Approvals: While we strive for “VoiceMatch” accuracy, you are responsible for reviewing and approving content. If no feedback is provided within 30 days of content delivery, those posts will be considered final and non-refundable.
6. Intellectual Property
-
Ownership: Upon full payment for the applicable service month, you own the copyright to the specific static images and text captions created exclusively for your brand.
-
License to Company: You grant Latitude Social a non-exclusive, royalty-free license to use the content created for you (and your brand name/logo) in our marketing materials and portfolio to showcase our work.
7. Third-Party Platforms
Our Services rely on third-party platforms (Facebook, Instagram, LinkedIn, etc.). Latitude Social is not liable for disconnections, technical outages, algorithm changes, or account restrictions imposed by these platforms.
8. Limitation of Liability
To the maximum extent permitted by law, Latitude Social shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, social media “reach,” or brand reputation, arising from the use of our Services. Our total liability is limited to the amount paid by the Client for one month of service.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Latitude Social is registered, without regard to conflict of law principles.
